Spieker Film Lab General Terms and Conditions
§1 Applicability to Businesses and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version in effect at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their self-employed professional activities (Section 13 of the German Civil Code (BGB)).
§2 Formation of a Contract, Storage of the Contract Text
(1) The following provisions regarding the conclusion of a contract apply to orders placed through our online store at http://www.spiekerfilmlab.de.
(2) Upon conclusion of the contract, the contract takes effect with

(3) The presentation of goods in our online store does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to enter into a purchase contract.
(4) Upon receipt of an order in our online store, the following provisions apply: The consumer submits a binding offer to enter into a contract by successfully completing the ordering process provided in our online store.
The ordering process consists of the following steps:
1) Select the desired items
2) Confirm by clicking the “Order” button
3) Review the details in the shopping cart
4) Click the “Proceed to Checkout” button
5) Log in to the online store after registering and entering your login information (email address and password).
6) Review and correct the entered information if necessary.
7) Submit a binding order by clicking the “Place Order” or “Buy” button
Before submitting the order in a binding manner, the consumer may, after reviewing their information, return to the web page where the customer’s information is entered by clicking the “Back” button in their web browser to correct any input errors or cancel the ordering process by closing the web browser. We will immediately confirm receipt of the order via an automatically generated email (“Order Confirmation”). With this, we accept your offer.
(5) Storage of the contract text for orders placed through our online store: We will send you the order details and our Terms and Conditions via email. You can also view the Terms and Conditions at any time at http://www.spiekerfilmlab.de/agbs. For security reasons, your order details are no longer accessible via the Internet.
§3 Prices, Shipping Costs, Payment, Due Date
(1) The prices listed include sales tax and other price components. Any shipping costs are added separately.
(2) Consumers may pay via PayPal or credit card (Visa, Mastercard, American Express).
§4 Delivery
Unless we have clearly stated otherwise in the product description, all items we offer are ready to ship immediately. Delivery will take place within 4 business days at the latest. The delivery period begins the day after the payment order is sent to the bank handling the transfer for payments made in advance, and the day after the contract is concluded for all other payment methods. If the end of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.
Shipping Costs: Shipping costs apply in addition to the listed product prices. The amount of the shipping costs is clearly stated during the ordering process.
Shipping Terms: Delivery will be made exclusively to the address provided by the customer. Customers may not pick up the merchandise themselves.
Delivery time: Unless otherwise specified, delivery within Germany takes [number of days] business days.
Transfer of Risk: For consumers, the risk of accidental loss or accidental deterioration of the goods sold during shipping does not pass to the customer until the goods are delivered to the customer.
Shipping Damage: If goods are delivered with obvious shipping damage, please file a claim with the delivery company as soon as possible and contact us immediately.
§5 Retention of Title
We reserve title to the goods until the purchase price has been paid in full.

Right of Withdrawal for Consumers
Consumers are entitled to a right of withdrawal under the following conditions, where “consumer” refers to any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity:
Right of Withdrawal for Goods
Consumers generally have a statutory right of withdrawal for goods ordered online. The details are set forth in our withdrawal policy.
Right of Withdrawal for Services
For services, the right of withdrawal may expire prematurely if we have fully performed the service and the customer has previously expressly agreed that we may begin performance before the expiration of the withdrawal period.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to goods that are not prefabricated and for which the customer’s individual selection or specification is decisive for their manufacture, or that are clearly tailored to the customer’s personal needs.
Online Cancellation
For contracts concluded online, we provide an electronic cancellation feature. This can be accessed via the “Online Cancellation” or “Cancel Contract” link.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days, starting from the date the contract is concluded.

by providing a clear statement (e.g., a letter sent by mail, fax, or email) regarding your decision to cancel this contract. You may use the attached sample cancellation form for this purpose, although its use is not required.
You can also cancel a contract entered into online using our electronic cancellation feature:
After submitting the form, you will receive confirmation that your cancellation has been received.
To meet the cancellation deadline, it is sufficient for you to send notification of your intention to exercise your right of cancellation before the cancellation period expires.
Consequences of Cancellation
If you cancel this contract, we must refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of your right of withdrawal with respect to this contract, compared to the total scope of the services provided for in the contract.

§8 Warranty
The statutory warranty provisions apply.
§9 LIABILITY
Spieker Film Lab is not obligated to pay compensation in excess of the value of the returned items. We are also not liable in any way for actions, errors, omissions, or delays that result in problems such as loss of revenue, business, profits, reputation, business interruption, or other losses. Please note that once the item has been shipped, we cannot be held responsible for delays in service by the courier used. Requests for shipping without tracking or insurance will be declined. Souped film is only available upon explicit request. If a souped film is submitted without prior notification, a disposal fee of 200 (including VAT) and a flat fee of 250 (including VAT) for the necessary new chemicals will be charged.
§9 Gift Certificates
Validity
A Spieker gift card is valid for 24 months from the date of activation. After that, any remaining balance will be removed, and the card will become invalid and can no longer be used.
Lost / Stolen / Damaged
If your Spieker Filmlab gift card is stolen or lost, we cannot replace or refund the remaining balance on the card.
§10 Language of the Contract
German is the only language available for the contract.
